In accordance with AFI 36-2905, Fitness Program, Air Force Guidance Memo 2, her commander signed a memo invalidating the FA and directed it not be entered into the AFFMS. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force in the grade of Staff Sergeant on the date of the FA in question. On 14 Jun 12, the applicant failed her FA, obtaining a composite score of 8.3 points for an AC measurement of 37.5 inches. The applicant’s most recent FA results are as follows: Date Composite Score Rating 18 Mar 13 89.10 Satisfactory 31 Jan 13 74.60 Unsatisfactory 11 Jul 12 81.50 Satisfactory 14 Jun 12 08.3 Unsatisfactory 22 Dec 11 84.80 Satisfactory 27 Sep 11 58.90 Unsatisfactory 31 Mar 11 82.30 Satisfactory 20 Jan 11 75.20 Unsatisfactory 21 Oct 10 56.90 Unsatisfactory The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility, which is included at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial, indicating there is no evidence of an error or injustice. The applicant indicates she was ill on the date of her FA; however, no documentation was provided which indicates she reported to the medical treatment facility for medical evaluation. Although the unit commander signed a memo indicating the FA was invalid, in accordance with AFI 36-2905, the authority to take this course of action is predicated on a medical evaluation. The applicant’s failure to provide a medical evaluation makes the unit commander’s memo invalid. A complete copy of the AFPC/DPSIM evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 18 Oct 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief. ________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2013-00633 in Executive Session on 4 Feb 14, under the provisions of AFI 36-2603: Panel Chair Member Member The following documentary evidence was considered: Exhibit A.  DD Form 149, dated 4 Feb 13, w/atchs.
